dumb mistake or cognitive failure? or "who pays the deductable?"

family is having an arguement over whether the person in the following scenario needs a cognitive functioning test.  S/he is not elderly.  Will call him/her "Pat"

Two cars are parked side by side. Pat is standing between them. A car pulls up and the driver parks their car behind the car on the LEFT.   A short discussion ensures over which car to take to go to dinner.  Pat, the driver, and everyone else gets into the car parked on the top RIGHT. 
Pat plows directly into the third car--saying s/he forgot it was there.
