I'm venting do not understand insurance or Law does not make any sense to me our insurance person told me it was up to us to get the broken tree limbs cut before they fall on our shed. We are suppose to protect our own property from the dummy next door with all of the trees. not our trees they are his trees.We have one tree in our back yard its in the middle of the yard not near power lines or anyone's house.Does not make sense to me why do we have to pay to cut our neighbors trees not our trees, I know my hubby he will never pay any one to cut our neighbors trees he does not believe in landscaping any way.Wish i could go to a lawyer and find out for sure about trees who is responsible for what. Yes i know life is not fair but sounds to me like that is a stupid law if it is true.

Take copies of the pictures to a lawyer that will give you a consultation for free. Explain the situation. Also try to get pictures of the fence that clearly shows the tree on his side of the property. Also make note of time, date, and location of any conversation that has transpired between you and the neighbor regarding the trees to the best of you memory. Give it one more try of talking to the neighbor and be very specific and write everything down while you are talking to him. If he asks why you are writing everything down tell him you are making notes to take to your lawyer and you don't want to mis quote him. That should get him moving. If not then you have a very strom case. And it can be solved easily with a letter from your lawyer. That should scare the crap out of your neighbor because who really wants to go to court. Also while you are talking to your neighbor make sure there are witnesses around to verify and explain to the neighbor that you don't want to have to go to court over this matter and ruin a relationship between the two of you. It could be easily solved just by a few strokes of a chain saw that can provide fire wood to keep someone warm!! If he is not willing with that then tell him you have another idea before going to court, you will call a tree service to take care of it and the bill will go to him since it is his property. That way you have given him plenty of oportunity and options for taking care of the problem and if he still doesn't there is no judge in the land that will side with him!!
OK so there is one last option, there can be a couple of hundred doxen in his yard protesting against him!!! (ok that would be funny!!)

In Illinois I have the right (and maybe the responsibility) to trim any shrubs or trees that hang over my property, even if the base is on someone elses.
Thanks to all that responded The bad thing is if we hire a tree service to cut down just the limbs on our side of the fence, the trees growing into our privacy fence will still keep growing ??? This would be a very expensive for us to have to have his dumb trees cut every few years plus the big trees will still be growing into our fence??? It is a no win situation the way I see it knowing my hubby he will try to get out there and cut the trees himself alone which would be dangerous for all and the houses too.Hubby is a tight wad + he already bought a 16" chain saw just hope he will not try to cut the trees himself. 1st day he got it he went out the door saying he had to go play with his new toy men will never understand them a chain saw is not a toy.

Papbouv, I couldn't see the pictures but I can relate an experience myself and hubby had regarding our neighbor's trees. We had a bad storm and part of the neighbor's huge tree fell over onto our back yard. Well it ended up just missing hitting the top of our chainlink fence and was laying all over our back yard but did not hit anything in our yard. I called our insurance company and they told me that it was an "Act of God" and we were responsible for paying to have the tree cut up and removed from our yard since it did not tear anything up and our insurance would not pay for it. Well...hubby and his friends decided to take care of it themselves....They tried to cut down the huge limbs and tree trunk that was hanging (actually suspended) over in our yard....and part of the tree ended up hitting our house and busting an awning in the back...so I called the insurance company again...this time I told them we had damage to the house because of an "Act of Gary" and they had to come out and replace the awning and the part of the roof the trunk hit, etc....hahaha...if they would have taken care of it in the first place, they would have had to spend a lot less money. Good luck with your predicament with your neighbor's trees....I hope you can get it taken care of...if not by the insurance company, then by an agreement with your neighbors!!!!!!!!
